Objection to the decision of the majority of co-owners to dispose of jointly owned real property. The court must, when determining it, ascertain that two conditions are satisfied. Their nature. Establishment of the possibility of partitioning the property in kind without harming the co-owners' interests. Disposal by majority decision is impermissible. Anyone wishing to terminate the co-ownership may seek partition. The court may appoint an expert to ascertain the elements necessary to determine the objection.
