State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Litigation can only arise between sandy tracts; otherwise, it is nonexistent, produces no effect, and cannot be rectified by a subsequent procedure. - A judgment rendered against a person whose death before the institution of the action is established is marred by a grave fundamental defect that deprives it of its existence and cannot be rectified. - The statement of claim must include the defendant's full name, profession or occupation, domicile, and workplace. Omission of this information. Its effect. The litigation is not constituted owing to the invalidity of its procedures.
