Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1894

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Omission to determine certain claims that permits the interested person to return to the same court for their determination. Its criterion. The omission must be due to inadvertence or mistake. If, however, the judgment implies an express or implicit ruling rejecting the claim, the means of challenging it is to appeal the judgment by the appropriate route, if it is amenable thereto. Example of a judgment ruling that an appeal is impermissible because determination of the claim was omitted, although the judgment determined it by rejection. Error. - 343 - Procedure
