Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1899

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Inadvertent omission to determine entirely a claim submitted to the court. The means of remedying it: recourse to the same court to determine it. - Challenging the judgment issued by the court of first instance because of its omission to determine the claim. Impermissible. The rationale: an appeal admits only claims determined expressly or implicitly by the appealed judgment.
