Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1908

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Application of Article 126 of the Civil Procedure Code. Its condition. The court must have entirely omitted to determine a substantive claim, leaving it pending before it without a ruling thereon. Its express or implied ruling dismissing the claim. Redress against it is by challenging the judgment through the appropriate avenue, if it is amenable thereto. Reason therefor. The court exhausts its jurisdiction by a conclusive ruling. Example.
Arabic original
