Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1915

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court of first instance's omission, through error or oversight, to adjudicate one of the claims. It is remedied by returning to the same court for consideration of it. The judgment may not be challenged by appeal in respect of that claim. Nor may the Court of Appeal undertake to adjudicate it, so as not to infringe the principle of litigation at two levels.
