State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The Births and Deaths Committee must investigate applications concerning lineage or correction of a name before actions concerning either are brought. Articles 1, 3, 4 of Decree-Law 1 of 1988. - The appellant's request to invalidate a power of attorney issued by the person whom he claims is his mother. Through his action, he seeks to establish his lineage to the person whose son he claims to be. Failure to submit the matter of lineage to the competent committee. Its effect: inadmissibility of the action as prematurely brought, which is a matter of public policy that the court rules upon of its own motion. A judgment declaring the action inadmissible as brought by a person without standing. Requires its cassation.
