Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2054

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Failure to reinstate a labour action after its striking out within the prescribed time entails its being deemed never to have existed, resulting in its extinction, including its originating statement of claim. The consequence of this: extinction of the effect of the request submitted by the worker to the Labour Department. - The basis for the effect attached by the legislature to a particular legal procedure is that the procedure originally conforms to what the law requires of it. - Interruption of limitation resulting from a judicial claim requires that claim to be valid in form and substance. This is not achieved except by issuance of a final judgment therein referring its claimant to all or part of his claim. Its termination otherwise extinguishes all legal effects arising from it. An example concerning a labour action.
