Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2091

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An action for enrichment without cause becomes time-barred upon the passage of three years from the day the injured person learns of his right to compensation, or upon the expiration of fifteen years from the day that right arises, whichever period expires first. What counts for commencement of the limitation period is the injured person's actual knowledge of his right. This is not realized until the day the final judgment of nullity is issued.
