Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2105

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The plaintiff's request in an original ownership action brought before commencement of enforcement and sale procedures, in addition to his request to confirm his ownership of the real property, for a judgment that the judgment awarding its sale is ineffective against him and that the enforcement procedures against it are void. A single indivisible subject matter admitting only one particular resolution with respect to all actual adversaries. Its consequence. All parties to that relationship, including the attaching creditor, must be joined. This is not altered by the fact that the legislature did not require the joinder of specified persons in an original ownership action as it required in the incidental ownership action provided for in Article 279 of the Civil Procedure Law.
