Article 279 of Code of Civil Procedure

A third party may seek annulment of enforcement proceedings together with a claim to ownership of the attached property or part thereof, by an action brought under the ordinary procedures before the competent court, against the attaching creditor, the creditors referred to in Article 2 / 265, and the debtor, possessor or surety in rem. At the first hearing, the court shall order a stay of sale proceedings if the statement of claim includes a precise statement of the evidence of ownership or facts of possession on which the action is based and is accompanied by supporting documents. If the day fixed for sale arrives before the court orders a stay, the claimant may request the sales judge to stay the sale, provided that he deposits in the enforcement file an official copy of the served statement of claim. Judgments rendered pursuant to the preceding two paragraphs staying the sale or allowing it to proceed may not be challenged by any means.
