Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2441

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Extinctive limitation. Its interruption by a judicial claim embodying an unequivocal demand for the right sought to be enforced. Effect thereof. A statement of claim brought for a right interrupts limitation only in respect of that right and its accessories which arise when it arises and lapse when it lapses. Difference between the two rights or their sources. A claim made for one does not interrupt the limitation period for the other right. - Establishment that the right in the previous action was confirmation of ownership by possession. Its difference from the subject of rescission of the land sale contract for breach of the obligation to transfer ownership. Rescission is not considered accessory to the claim for confirmation of ownership because it does not arise when that claim arises or lapse when it lapses. Consequence thereof. The previous action does not interrupt limitation in the latter action. Contravention thereof. An error requiring cassation of the judgment.
