Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2475

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An unregistered sale. Creates obligations incumbent on the seller, including transfer of ownership, and obligations incumbent on the buyer, including payment of the price. - An action for the validity and enforceability of a sale. Its purpose is to address the seller's refusal to carry out the acts necessary to register the sale contract. The judgment rendered therein is conclusive evidence that the sale was validly and enforceably concluded. Its registration transfers ownership of the thing sold without the seller's intervention. The challenged judgment's failure to confine itself to that, its ordering the seller to register the property sold in the buyer's name, and its making his receipt of the balance of the price conditional upon registration. An error in the application of the law.
