Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2675

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The binding effect of a criminal judgment in a civil action. It does not extend beyond matters necessarily determined by the criminal judgment for its ruling concerning the occurrence of the act forming the common basis of the civil and criminal actions, the legal characterization of the act, and its attribution to its perpetrator. Example: acquittal of the crime of fraud has no binding effect in an action for compensation. Reason: the crime of fraud is not constituted merely by false statements and allegations; rather, they must be accompanied by outward manifestations inducing the victim to believe them to be true, whereas mere concealment or lying constitutes the deceit permitting annulment of the contract. This means that what the criminal judgment necessarily determined for its ruling relates only to the criminal action and does not represent a common basis with the civil action. - 512 - Civil Procedure Appearance and absence of litigants - In general:-
