Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2722

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Joinder as a respondent to a challenge. It is insufficient for the person joined to have been a party to the proceedings before the court that rendered the judgment. He must be a genuine adversary, namely a person against whom claims were directed by his opponent or who directed claims against that opponent and maintained his dispute with him until judgment was rendered in the action.
