Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2742

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A judgment staying an appeal as a sanction. The obligation to resume its progress within the thirty days following the expiry of the stay period. The reason therefor. Urging the party charged with resumption to pursue the proceedings without delay. Resumption is not effected except by constitution of the proceedings through service on the other party within the time limit. Filing the resumption petition with the registry is insufficient. Expiry of the time limit. Its effect: the permissibility of ruling that the appeal be deemed never to have been brought. The criterion therefor: established default or negligence by the appellant in implementing what the court ordered. An example: absence of the default or negligence warranting application of the sanction.
