A cassation appeal is deemed brought from the date its petition is filed with the registry. - Nullity of service does not affect the appeal, and the defect in service may be rectified without filing a new petition. - Nullity shall not be adjudged, notwithstanding a provision for it, if the defect affecting the procedure caused no prejudice to the litigant. Example. - A cassation appeal falls outside the scope of application of the sanction of deeming an action or appeal never to have existed.
