English translation of the principle
A cassation appeal is considered brought from the date its petition is filed, without regard to the time when it is served on the respondent. Effect thereof. Invalidity of service does not affect the appeal. Implication thereof. A cassation appeal falls outside the scope of application of the sanction of deeming an appeal as never having been brought for failure to effect service within the time limit.

الطعن بالتمييز يعتبر مرفوعاً من تاريخ إيداع صحيفته دون الاعتداد بالوقت الذي تعلن فيه للمطعون ضده. أثر ذلك. أن بطلان الإعلان لا يؤثر على الطعن. مؤداه. خروج الطعن بالتمييز من مجال إعمال جزاء اعتبار الطعن كأن لم يكن لعدم الإعلان في الميعاد.Original Arabic judgment citations
