Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3321

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The decisive oath. Prescribed as a refuge for the person requesting it when he lacks other means of proof. The person to whom it is directed must take it immediately if present, or otherwise be deemed to have refused it, so long as he does not dispute its admissibility or relevance to the action. If he does not appear, he must be served with the operative part of the judgment and summoned to appear. Assessment of the excuse for non-appearance thereafter. A matter for the court of merits.
