Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3323

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The criterion for the validity of service of an appeal at the elected address is that the party must have designated it as their elected address in the document serving the judgment. Neither the date of submission of the statement to the authority competent for service nor its receipt by the process server is taken into account for service. What matters is actual delivery of its copy to the intended addressee in accordance with the prescribed formalities. What the process server must do if the person addressed refuses to receive its copy.
