Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 371

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Nullity of the judgment under appeal owing to a defect in it or in the procedures preceding it, without the nullity extending to the statement of claim. The court must not stop at declaring nullity and must decide the merits by a new judgment observing proper procedures. This is not considered deprivation of a level of adjudication. - 73 - Civil Procedure
