Kuwait Court of Cassation principle number 4316

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments rendered during proceedings which do not conclude the litigation. The general rule. They may not be appealed independently. The exception. Provisional and urgent judgments, judgments staying proceedings, and judgments capable of compulsory enforcement. Article 128 of the Civil Procedure Law. The rationale. An example concerning the inadmissibility of an appeal in cassation against a judgment rejecting the plea that the courts lack jurisdiction to hear the dispute, setting aside the appealed judgment, and remitting the action to the court of first instance for determination on its merits.
