Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 44

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Litigation is unaffected by a change in the representative of a legal person. The basis for that: the intended party to the litigation is the legal person itself, not its representative. The reason for that: a change in the capacity in which it is represented may not be a cause for obstructing proceedings. Example.
