Kuwait Court of Cassation principle number 45

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The ordinary judiciary is the default repository of judicial authority. Anything else is an exception that may not extend beyond the sphere delineated for its jurisdiction under the law conferring it. What counts in determining jurisdiction is the relief sought by the plaintiff in his action. Example.
