Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 458

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A challenge alleging absolute simulation that the court is obliged to examine. It must be explicit in its meaning. Merely challenging on grounds of collusion or fraud. Does not convey that meaning. - A registered contract takes precedence over an unregistered contract even if collusion between its parties to deprive the first purchaser is established. The second purchaser who registered his contract having knowledge of the prior sale. Does not in itself constitute an indication that the subsequent sale is simulated.
