State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The debtor's notarization of an acknowledgment accepting the indebtedness balances as existing on 1/8/1990. Its necessity to benefit from the facilities provided by Law 41 of 1993. Inadmissibility of his subsequently disputing the existence or amount of that indebtedness. Reason therefor. Stability of the financial positions of all parties. His disputing the debt itself and its amount. Effect thereof. The court may rule that he is deemed to have abandoned his action or appeal, and abandonment is not limited to relinquishing the litigation proceedings while the substantive right remains unchanged, but rather constitutes a final settlement concerning the amount of the debt and an undertaking not to dispute it in the future.
