Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 630

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Dispositions capable of both benefit and detriment. What is meant thereby. Example. - Reliance by a person of diminished capacity on his diminished capacity. His having claimed to possess capacity does not prevent this. - A minor's resort, in order to conceal his diminished capacity, to fraudulent methods capable of concealing his diminished capacity. His obligation to compensate the person who contracted with him for the harm resulting from annulment of the contract. The distinction between a minor and a person of diminished capacity in this regard: the ruse used by a minor to conceal his age may deceive an ordinary person, whereas, for persons of diminished capacity other than minors, such as spendthrifts and the gullible, it is difficult for it to deceive an ordinary person.
