State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that agency terminates upon the death of the principal or the agent, or upon either losing capacity. The reason therefor: personal considerations are taken into account in selecting the agent. - The agent’s heirs must promptly notify the principal of their predecessor’s death and take such measures as circumstances require in the principal’s interest. Its condition: that they possess capacity and know of the agency.
