Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 961

State of Kuwait · Pleadings — Part Two · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Valuation of the action in relation to the appeal threshold is based on the parties' final claims. The reason therefor. - The Court of First Instance's final-instance threshold is 5,000 dinars. It encompasses all disputes that the said court has jurisdiction to determine at first instance. - The general rule is that judgments issued by the court of first instance in a final capacity are not appealable. The exception. - The appellant's specification of his claims at first instance as a declaration that he owes no debt for the maintenance awarded against him and an order requiring the respondent to return KD 2920 is, in reality, a single claim for repayment of that sum, on the basis of which the action is valued; the judgment issued is not appealable because its value falls below the threshold. The challenged judgment's departure from this view and its implicit ruling that an appeal is permissible. Renders it defective.
