Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1332

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Appointing a worker under a written or oral contract. Permissible. - The worker and employer may prove the employment relationship by all means of proof as long as there is no written instrument establishing it. An oral contract is like a written contract. It may be proved whether for a fixed or indefinite term. Example. - The challenged judgment's dismissal of the female appellant's claim for payment in lieu of notice on the basis that the papers did not disclose whether the employment contract was for a fixed or indefinite term, despite the respondent's not disputing that she had worked for it until it prevented her from working at the company. Inadequacy of reasoning requiring its cassation. - 209 - Civil Procedure
Arabic original
