Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1365

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The reasons of a judgment are considered tainted by unsound inference if they contain something affecting the soundness of deduction. Instances thereof: reliance on evidence unsuitable for forming a conviction, failure to understand the factual elements, or contradiction between them, as where the outcome reached by the judgment on their basis does not follow logically. An example: the judgment’s inferring from the reinstatement of the action after its striking out a release from and withdrawal from the settlement, although such reinstatement does not in itself indicate this. Vitiates it with unsound inference and requires its cassation.
