Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1404

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

It being established that the apparent agent is a non-Kuwaiti prohibited from engaging in trade on his own account or owning a commercial establishment, and that his signature on the papers of the establishment he represents was in his capacity as its representative. The indication this provides of the good faith of the person dealing with him, namely that he could only be acting as an agent for its owner, thereby establishing apparent agency. Contravening this indication constitutes error, unsoundness and contradiction of what is established in the record.
