The right of the judge of merits to infer whether or not a contracting party breached an obligation giving rise to contractual liability. Its condition. That the inference be reasonable and derived from elements leading to it. Example of a defective inference of a female warehouse owner’s liability for a fire therein, without scrutinizing her defense based on her performance of her contractual obligations and without stating the nature of her breach of her obligations, with the reasons being incoherent and contradictory concerning the cause of the fire.
