Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1475

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A claim or defence upon which the court of merits is unequivocally requested to rule and which would change the view taken of the action. It must answer it with specific reasons; otherwise its judgment is deemed devoid of reasons, requiring its cassation. - A request to appoint an expert is not a right of the litigants that the court of merits must grant in every case. Its refusal to grant it. Its necessary consequence. That it state the reasons for its refusal. The Court of Cassation’s review in this regard. An example of answering a request to appoint an expert in a manner unfit to answer the defence in respect of which it was made, requiring cassation of the judgment for infringement of the right of defence and deficiency in causation.
