Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1481

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A final judgment is one that determines the dispute between the parties and prevents returning to the same dispute through a subsequent action. A judgment’s contravention of this renders it defective for infringement of the right of defence and inadequate reasoning, requiring its cassation.
