Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1513

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A complete omission to adjudicate certain claims through oversight or error. Its remedy is recourse to the same court that omitted them, not challenging the judgment. The Court of Appeal’s not addressing the claim omitted by the court of first instance. No deficiency.
