English translation of the principle

Definitive judgments. These are judgments that put an end to the dispute in its entirety or in part, or to an issue arising from it, through a conclusive determination from which the court cannot retreat. Such judgments are protected by the authority of res judicata, unlike non-definitive judgments, which do not restrict the power of the court that issued them to hear and determine the dispute in any manner it sees fit. The condition for this authority: that the judgment has not decided, in its reasons or operative part, a segment of the dispute or an issue arising from it. - A plea that the court lacks subject-matter jurisdiction to hear the action. A judgment accepting or rejecting it acquires the authority of res judicata before the courts of the judicial order that issued it, even if it contravenes public policy or was issued by a court lacking jurisdictional authority to issue it. - 259 - Procedure
