Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1788

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments rendered during the course of an action, of whatever kind, may not be challenged independently before issuance of the final judgment terminating the litigation therein. The exception. Example: a judgment recording discontinuance of the proceedings against a litigant, reversing the first-instance judgment and remitting the action to the court of first instance for determination is a judgment that does not terminate the litigation and is not among the exceptions, and therefore may not be challenged.
