Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1789

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judgments rendered during the proceedings before the final judgment terminating them. May not be challenged independently. Exception. Interim and urgent judgments, judgments staying the action, and judgments on part of the merits that are amenable to compulsory enforcement. Reason: preventing the fragmentation of a single case and its distribution among several courts, with the resulting delay in determining the merits and increased litigation expenses. Example. - A judgment declining subject-matter jurisdiction and referring the case does not terminate the proceedings and does not fall within the exceptions. - 286 - Civil Procedure
