Kuwait Court of Cassation principle number 1805

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Commencement of the time limit for challenging a judgment. The general rule is that it runs from the date of pronouncement of the judgment. The exception. Its cases include the failure of the party against whom judgment was rendered to attend all hearings scheduled for consideration of the action and to submit a memorandum of defence, and at all hearings following resumption of the action after its progress had ceased, even if he had attended earlier hearings. The time limit for challenge begins on the date of service of the judgment. An example of the failure of the party against whom judgment was rendered to attend after resumption following striking out.
