Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2036

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Quashing a judgment in its entirety entails its extinction, the erasure of its res judicata effect, and the quashing of judgments founded upon it, even if rendered in an action other than that in which it was rendered. This rule prevails over considerations of public policy. The Court of Cassation may apply it of its own motion.
