State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Proceedings can exist only between living persons; otherwise, they are non-existent, produce no effect, and cannot be cured by a subsequent procedure. - A judgment rendered against a person proven to have died before the action was instituted is vitiated by a serious fundamental defect that deprives it of its existence and cannot be corrected. - The statement of claim must include the defendant’s full name, profession or occupation, domicile, and place of work. Omission of these particulars. Its effect. Failure of the proceedings to be constituted owing to the nullity of their procedures.
