Service of the statement of claim. A condition for the constitution of proceedings. Contravention thereof. Its effect. Extinction of the proceedings and nullity of the judgment, which the court may declare of its own motion. Its ruling that the appealed judgment is void because service of the statement of claim is void. Necessary consequence. It must confine itself to declaring nullity without adjudicating the merits.
