Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2280

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Standing in the litigation. It is established for the person who was a party, not his representative, in the litigation in which the judgment was rendered. The reason for this. The action is not his action but that of the person he represents, and what matters in identifying the litigant is the reality presented in the action. - The judgment naming the agent as the litigant without coupling his name with the phrase “in his capacity.” A clerical error of expression which does not obscure or cast doubt upon the true identity of the litigant and his connection to the litigation, and does not in itself constitute a ground for cassation appeal. A challenge on this ground. Inadmissible.
