Kuwait Court of Cassation principle number 2401

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The party for whom the executory formula is appended to the judgment. A person having an interest in enforcement of the judgment, even if criminal, whenever it contains a ruling on a civil matter, on what must be returned, on compensation, or on costs. Article 118, Civil Procedure. - The assertion that the expression ‘person having an interest’ refers only to a person who was a party to the judgment sought to be enforced. Constitutes a departure from the correct meaning of the wording of the provision. The judgment’s restriction of the request to affix the executory formula to a criminal judgment to the Public Prosecution. A violation of the law and an error in its application requiring its cassation.
