State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An appeal petition in a dispute exceeding five thousand dinars in value. It must be signed by a lawyer admitted before the Court of Appeal. The purpose of this. Observance of the provisions of law in its drafting. Omission thereof. Effect: nullity relating to public policy. The margin of the petition contains an illegible signature, but it is not accompanied by the signatory's name or capacity, the petition and its copies contain no indication that it belongs to a lawyer, and the appellant provides no evidence of this. The judgment declaring the appeal petition void for not being signed by a lawyer. No defect.
