Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2552

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Omission from the appeal petition of the name of the female owner of the sole proprietorship. When it does not create uncertainty as to her true status and connection with the litigation. The judgment declaring the appeal void on the basis that it was brought by a sole proprietorship without being accompanied by its female owner’s name, despite referring in its recitals to what indicates rectification of the form of the action. A violation of the law and an error in its application.
