State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Grounds of appeal. Their inclusion of such substantive or legal grounds as the appellant considers would lead to setting aside or varying the judgment appealed against. Stating some grounds of appeal in the appeal petition is sufficient, and other grounds may be added without being bound by the time limit for appeal or its service. The grounds stated in the petition may be abandoned in favour of other grounds, and the Court of Appeal may base its ruling in favour of the appellant on grounds other than those stated in the appeal petition. - Stating the grounds of appeal in its petition. Its purpose: to ensure the seriousness of the challenge, not to define its scope. It is sufficient to state those grounds in concise, meaningful terms that remove ambiguity.
