Standing to challenge. It belongs to the litigant, not his representative, since the action is the litigant's action, not his representative's. Example: a first-instance judgment rendered against the Minister of Education in his official capacity. The Ministry's Undersecretary may appeal it in his official capacity. The reason therefor. - The Minister may entrust some of his powers to the Ministry's Undersecretary.
