Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3066

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court of first instance ruling that the action seeking appointment of an expert has ended after the expert submitted his report. The plaintiff has no interest in challenging this judgment. This is not altered by his seeking on appeal what the expert's report yields. The reason therefor. - The rule that new claims are inadmissible on appeal. Its consequence: the Court of Appeal is bound by the litigants' claims before the court of first instance and within the limits of the appeal. This rule pertains to public policy. - The appellate judgment not addressing the request for an award of what the expert's report yielded where the claims at first instance were merely for appointment of an expert.
